Victims and family members face challenges in asbestos lawsuits

There are a number of reasons why many people may be hesitant to take legal action when it comes to asbestos-related illnesses. It can certainly be overwhelming, confusing and intimidating and many people may not understand what rights they have. However, working through the process of filing a lawsuit and pursuing compensation can be much easier with the help of an attorney.

We read about the obstacles that many victims and their families face when it comes to asbestos litigation, but we also read about a number of success stories. No matter how hard companies try to delay justice or deny responsibility, it can be important to stay persistent and work toward a positive outcome. A judge recently ruled that four separate cases could proceed in the state in which they were filed. A total of 38 defendants were challenging the lawsuits filed against them, claiming that they should be dismissed based on jurisdiction. 

This is just one legal tactic that companies utilize to try and draw out the legal process and avoid being held accountable for negligent or reckless asbestos practices. Defendants are required to prove that another location would be more convenient to all parties involved. If they fail to do so, which was the case here, the request for dismissal can be denied.

Legal strategies like this can be frustrating and confusing for people who are unfamiliar with the process of asbestos litigation. However, with the help, experience and guidance of an attorney who has extensive knowledge in this arena, victims of asbestos-related illnesses and their families can fight back against these companies and pursue the compensation they deserve.
