Victims and family members face challenges in asbestos lawsuits

There are a number of reasons why many people may be hesitant to take legal action when it comes to asbestos-related illnesses. It can certainly be overwhelming, confusing and intimidating and many people may not understand what rights they have. A judge recently ruled that four separate cases could proceed in the state in which they were filed. A total of 38 defendants were challenging the lawsuits filed against them, claiming that they should be dismissed based on jurisdiction. 

This is just one legal tactic that companies utilize to try and draw out the legal process and avoid being held accountable for negligent or reckless asbestos practices. Defendants are required to prove that another location would be more convenient to all parties involved. If they fail to do so, which was the case here, the request for dismissal can be denied.

Legal strategies like this can be frustrating and confusing for people who are unfamiliar with the process of asbestos litigation.
